Pringles Consumer Promotion - Terms & Conditions



General

1. The promoter to this competition is Kellogg Company South Africa (Pty) Ltd acting on behalf of Pringles International Operations SARL Singapore Branch, (Company Registration No.: T11FC0154H), a Singapore branch of Pringles International Operations SARL, duly organised and existing under the laws of Singapore with its registered office at 238B Thomson Road, #10-01/08 Novena Square, Tower B, Singapore; [SA Local Consumer Contact Centre: 0860 200 601] (“the Promoter”).

2. The Pringles Consumer Promotion (“the Promotion”) is open to all residents of South Africa who are aged 18 years or older permanently residing in the Republic of South Africa and meet the requirements of these terms and conditions, excluding employees and their immediate families of Pringles International Operations SARL Singapore Branch or the Kellogg Company South Africa (Pty) Ltd (“the Promoter”), its related bodies corporate and its associated parties where “Associated Parties” includes without limitation, the agents, contractors, and distributors of Pringles that are involved in this Promotion.

3. All persons entering this Promotion ("the Entrant/s") agree that the promotion terms and conditions as set out herein are binding on them.

4. All entries submitted in compliance with these terms and conditions will not be disqualified and shall be considered legible.

5. To participate, Entrants must:

        5.1 purchase in one transaction 2 (two) or more 110g can/s of Pringles (of any flavour); and

        5.2 write their name/s and contact details clearly on the receipt from the merchant and place the receipt into the promotion box provided in-store.

6. Incomplete entries will be considered illegible and will not be accepted for this Promotion.

7. Entries for the Prize open at 9am on 6th July 2015 and closes at 17:00pm on 30th August 2015 (“the Promotional Period”). The official clock for this Promotion is the Promoter’s computer.

8. By entering the Promotion in accordance with these terms and conditions, you are entering a promotional competition for the purposes of the Consumer Protection Act, 2008 ("CPA") and the promotional competition will be conducted in accordance with the relevant provisions of the CPA. Should you win a prize in this Promotion, you undertake to expeditiously do all things necessary to enable the Promoter to comply with its obligations under the Consumer Protection Act 68 of 2008 including, but not limited to (i) providing such personal information as may be required in order to facilitate handing over the prize (including providing proof of address and identity number) and (ii) signing receipt of the prize upon its delivery.

9. All entries submitted for this Promotion, must be completely original for each Entrant and must not have been copied, reprinted, written, formed or produced, in whole or in part, from any other source other than the merchant in order to be legible as an entry for this Promotion. Entries which contain materials that are not of the original receipt from the merchant are illegible for this Promotion.

10. Entries submitted must not include, depict or make reference to any of the following: obscenity, explicit or inappropriate language, unauthorised copyrighted or trademarked properties, including brand names, material that is hateful, defamatory, disparaging, slanderous or otherwise unlawful, material that violates or infringes another's rights, including but limited to, rights of privacy or publicity or any other intellectual property rights, material that promotes bigotry, racism, hatred or harm against any group or individual, or promotes discrimination based on race, ethnicity, sex, religion, nationality, disability, sexual orientation or age, or any other basis protected by federal, state or local law, ordinance, regulation or by-law, and any other content that could be considered inappropriate or offensive, as determined by Promoter in its sole discretion.

11. The winner shall be required to provide consent to grant Promoter and their respective representatives, affiliates, licensees, successors an assigns: (i) the right, but not the obligation, to edit, adapt, reformat, rearrange, modify, combine with other material, add to and/or customise imagery, pictures or photographs of the winner; and (ii) the non-exclusive, irrevocable, royalty free, right and/or license to exhibit, display, broadcast, copy, reproduce, encode, compress, encrypt, incorporate data into, rebroadcast, transmit, record, publicly perform, create derivative works of, distribute and synchronize in timed relation to visual elements, and or otherwise, exploit, the winner’s imagery, pictures or photographs, and/or any portions or excerpts thereof, in any manner including advertising, promoting and publicising Promoter, an unlimited number of times, in any or all media, now known or hereafter devised, in perpetuity, throughout the world, without any additional liability, obligation or additional payment of any kind to Entrant or any third party, which includes but is not limited to the website https://www.www.pringles.com and/or Pringles Facebook page, YouTube, and other internet forums, websites, permanently or temporarily.

12. All information provided by the Entrant must be complete and accurate.

The Prize

14. This Promotion entitles you to a chance to win a Harley- Davidson 883 Iron Motorcycle (“the Prize”).

15. Winners will be notified by SMS/telephone/email/fax or depending on the details provided. If a winner does not respond within 3 (three) days of first being contacted by the Promoter, is not reachable, or if a notification email/fax to a winner is returned as undeliverable, the winner may forfeit their right to receive the prize and a replacement winner may be selected.

16. Participation is not limited to one entry per person.

17. Winners are determined by random draw taking place on 16TH September after the Promotional period.

18. Winners must collect the Prize within 3 weeks from the time notified by the Promoter (“the Adjudication Period”), after which the Prize will be forfeited.

19. The Promoter reserves the right to confirm the identity of the winner/Entrant. The winner/Entrant may be asked to produce all necessary and valid documentation prior to the Adjudication process or prior to the prize being awarded.

20. The Promoter and its agents do not accept any liability for lost, stolen or damaged Prizes.

21. The Promoter does not make any representations or give any warranties, whether expressly or implicitly, as to a prize, and in particular, but without limitation, make no representations and gives no warranty that:

        21.1 your entry or participation in the competition will necessarily result in you winning a prize;

        21.2 a prize, or any aspect thereof, will meet your, or, if applicable, any person’s requirements, preferences, standards or expectations; or

        21.3 a prize, or any aspect thereof, will be satisfactory, punctual, free from defects, safe or reliable.

22. Prizes are not transferable, may not be deferred, changed or may not be exchanged for cash or other Prizes.

The Promoter’s Rights

23. All entries for the Promotion once submitted become the exclusive property of the Promoter and will not be acknowledged nor will they be returned.

24. Promoter reserves the right to disqualify any entry submitted that they deem, in their sole discretion, to be a violation of these terms and conditions or that are not in keeping with the Promoter's image.

25. The Promoter accepts no responsibility for entries that are lost, damaged, corrupted, delayed, and illegal or which are unable to be submitted due to software or hardware failure or for any other reason beyond its control including unavailability of the websites, network or telecommunication failures.

26. By entering, a participant acknowledges that personal information about prize winners will be shared with the Promoter's agents to the extent necessary for prizes to be delivered to prize winners.

27. To the extent permitted by law, the Promoter does not accept any responsibility or liability to compensate the participants, or accept any liability for any personal loss or injury occurring using the Prizes or otherwise arising in relation to the Promotion.

28. The winner/s will be required to sign an affidavit of eligibility (which affirms that he/she has complied with these rules) as well as a liability release, and where necessary, a publicity release, each of which must be completed, signed and returned within five (5) days from date of issuance, or the prize will be forfeited and awarded to alternate winner.

29. To the extent permitted by law, the Promoter does not guarantee the quality of the Prizes and cannot be held liable for any personal loss or damage arising in connection with this Promotion.

30. The Promoter reserves the right to cancel or withdraw your eligibility to participate in this Promotion, including any offers made under it, in the instance of fraudulent activity or other breach of these terms and conditions.

31. The Promoter reserves the right to withdraw, amend or substitute this Promotion with another Prize of equal or greater value. Promoter may need to vary these terms and conditions from time to time, at their discretion.

32. Although the Promoter has taken care to make sure that the prize/s is/are of a good quality, it does not give any warranties about the prize/s and you agree to accept the prize/s “as is”.

33. Except for any liability that cannot by law be excluded, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion including, but not limited to, those arising out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in the Prize to that stated in these terms and conditions; or (e) any tax liability incurred by a entrant/winner.

34. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any Entrant/winner; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the offer, as appropriate.

35. These terms and conditions form your entire agreement with the Promoter in relation to this Promotion.
